Cancellation Rights
You will have no right to cancel the order if:
1. Any damage to the vehicle has been sustained following delivery of the vehicle (irrespective of whether the damage was caused by you or any third party other than us or our appointed delivery agents) unless we decide to accept the vehicle as damaged upon terms that you will pay to us an agreed sum of money to fairly and adequately compensate us for the cost of repairing the damage to the vehicle and/or any depreciation in the value of the vehicle;
2.You are unable for any reason to return possession of the vehicle to us.
3.The vehicle has been made or modified to your specifications;
4.You have chosen to have the vehicle delivered and you exceed the preliminary mileage following delivery.
5.You have chosen to collect the vehicle and the mileage of the vehicle has exceeded the distance from our collection centre to your contact address (refers to distances over 100 miles).
6.You have been in possession of the vehicle for more than 168 hours (7 Days)
Availability Date
We provide expected production/delivery dates quoted to us by the supplying manufacturer approved dealer. We cannot be held responsible if the dates change due to any manufacturing/dealer problems. We do however take every precaution necessary to ensure that all timescales are met and typically overstate rather than understate delivery times to avoid disappointments.
Part Exchange Vehicle
We shall provide a part-exchange valuation for your vehicle based upon the information you submit to us and detailed in the contract. We agree to accept your part-exchange vehicle in lieu of payment of the amount of the part-exchange valuation as a part of the contract subject to the satisfaction of each of the conditions set out below.
1.That the part-exchange vehicle is your own property and is either free from all encumbrances, or is subject only to one or more encumbrances capable of a cash settlement, in which case we will (after we have received your part-exchange vehicle and delivered the vehicle to you) apply an appropriate amount of the part-exchange valuation to any appropriate third party to discharge any such encumbrances, and you accept that the amount of the part-exchange valuation shall accordingly be reduced (and the amount of the purchase price payable by you in cleared funds correspondingly increased) by the amount required to discharge any such encumbrances as aforesaid;
2.That we have been given reasonable opportunity to examine your part-exchange vehicle to confirm the appropriate level of the part-exchange valuation and that such examination has taken place to our satisfaction;
3.That we receive your part-exchange vehicle from you in substantially the same condition as was specified by you in the information provided to us pursuant to which the part-exchange valuation was calculated (fair wear and tear accepted);
4.That your part-exchange vehicle is collected by us at the same time as or before delivery of the new vehicle is made to you, and that title in your part-exchange vehicle passes to us absolutely upon collection
5.That the statements and representations made by you in relation to your part-exchange vehicle (including all statements, assessments and representations submitted by you on the site) are accurate and complete in all respects.
If for any reason:-
1.Your part-exchange vehicle is not collected by us within a period of 60 days of the date of the part-exchange valuation (this shall apply whether the delay in the collection of your part exchange vehicle is by us, our appointed collection agents or you); or
2.The total mileage of your part-exchange vehicle on collection by us exceeds the estimated mileage used for the purposes of calculating the part-exchange valuation then;
we reserve the right to recalculate the value of your part-exchange vehicle to take account of the increased mileage and any other factors which may reduce the value of your part-exchange vehicle since the part-exchange valuation was calculated, and you agree to be bound to pay the purchase price in accordance with these conditions utilising the recalculated value of your part-exchange vehicle in the contract.
If any of the conditions set out above are not satisfied we will be discharged from any obligation to purchase your part-exchange vehicle or to confirm the part-exchange valuation, in which circumstances we will have the choice to decide whether:
1.You will be bound to pay the purchase price in full in accordance with these conditions without the part-exchange vehicle, (unless you decide to cancel the contract); or
2.We will accept the part-exchange vehicle and make an appropriate deduction in the part-exchange valuation (by recalculating the value of your part-exchange vehicle where appropriate) to fairly and adequately compensate us for any inconvenience, losses, expenses, adverse tax implications or charges we incur, and you will then be bound to pay the purchase price in accordance with these conditions utilising the part-exchange valuation as varied, (unless you decide to cancel the contract)
Where we have agreed the part-exchange valuation of your part-exchange vehicle in accordance with these conditions, and you cancel the contract after we have collected the part-exchange vehicle from you, we may (at our absolute discretion) either return the part-exchange vehicle to you, request that you collect it from us or pay to you a sum of money equal to the amount of the part-exchange valuation of the part-exchange vehicle.
Payment terms
When an order is placed you are required to pay a deposit of £500 (special order and vehicles over £20,000 may be subject to a higher deposit) into the UK Car Discount Limited account. Upon completion of the order process an order confirmation will be dispatched to you together with a receipt for your deposit.
The purchase price less the deposit and the amount of any part-exchange valuation agreed by us, shall be payable in pounds sterling by you (or by any finance company) by bank draft or building society cheque payable to UK Car Discount Limited upon delivery of the vehicle and subject to your satisfaction as to its condition. If you fail to pay any sum due under the contract you will be liable to pay interest on such sum from the due date for payment at the annual rate of 3% above the base lending rate from time to time of National Westminster Bank Plc, accruing on a daily basis until payment is made, whether before or after any judgment. If no specific due date for payment has been agreed, the due date for payment shall be deemed to be:
1.The date of actual delivery of the vehicle;
2.The date of collection of the vehicle; or
3.(if earlier in time) The date falling seven days after the date of the notice we give to you that the vehicle is ready for delivery or collection.
Fulfillment/cancellation of contract/order
UK Car Discount Limited do not guarantee to fulfil an order. Should we be unable to fulfil an order due to circumstances beyond our control, force majeure, natural disaster, war, etc, or if the vehicle proves to be (in our opinion) not of merchantable quality for whatever reason we reserve the right to cancel the order and refund the deposit in full. The customer will be given the opportunity to submit a replacement order if so desired. UK Car Discount Limited will not be liable for any consequential loss incurred due to cancellation of the order.
We are entitled to cancel the contract immediately by written notice to you if:
1.You fail to take delivery of the vehicle when delivery is attempted by us or our appointed delivery agents at your address in the United kingdom specified for delivery in the order;
2.You fail to ensure collection has taken place within 14 days of the collection date agreed with you;
3.You commit any breach of any of these terms and conditions;
4.You do not pay the purchase price (or any part of it) when requested to do so (or if we have cause to believe that the purchase price (or any part of it) will not be paid by you upon request);
5.In circumstances where it is reasonable to assume that the contract has been formed upon the basis of a typographical or arithmetical error on the site in relation to any term of the contract (including but not limited to the purchase price).
If the order is cancelled by you deposits are non refundable unless your decision to cancel is as a result of any failure on our part to fulfil your order. If the order is cancelled by us due to a failure by you to take delivery of the vehicle the deposit will be non refundable.
We may decide to return a deposit less any costs incurred as a gesture of goodwill. The refund of deposits is at the absolute discretion of UK Car Discount Limited and will not be construed as an admission or acceptance of any error on our part. This does not affect your statutory rights.
Delivery
In the event that you select to have your vehicle delivered, we will endeavour to get your vehicle to you in the same prepared condition it left our holding centre. However, you hereby accept that due to road and environmental conditions the vehicle may not be perfectly clean and may have suffered such reasonable “fair wear and tear” as would be expected during a road journey from its storage location to your address for which you accept we shall not be liable unless caused as a direct result of our negligence.
Your Rights
The interpretation, construction, effect and enforceability of this agreement shall be governed by English law, and you and we agree to submit to the exclusive jurisdiction of the English courts for the determination of disputes.
The headings in this agreement shall not affect its interpretation.
If any term or provision in the agreement shall be held to be illegal or unenforceable, in whole or in part, under any enactment or rule of law, such term or provision or part shall to that extent be deemed not to form part of this agreement but the validity and enforceability of the remainder of this agreement shall not be affected. " order" means the order completed by you for the purchase of the vehicle from us incorporating details relating to your payment of the purchase price, part-exchange vehicle (if applicable), and your chosen option of delivery or collection and all other details requested by us;
" order confirmation" means the written confirmation of the order to be forwarded by us to you upon acceptance of the order by us;
" part-exchange valuation" means the amount assessed by us as being the value of your part-exchange vehicle.
" part-exchange vehicle" means the vehicle (if any) offered by you to us in part exchange for the vehicle, details of which you have provided to us in contact with our customer service team
" purchase price" means the total price payable by you for the vehicle and any agreed delivery option (including the cost of any options, accessories, extended warranties, road fund licence, value added tax applicable at the date of the order; and
" vehicle" means the motor vehicle (together with any options and accessories) detailed in the order.
" preliminary mileage" refers to a fair distance to test drive the vehicle to assess that it is of satisfaction subject to a maximum distance of 100 miles .
